HC bars ex-CM’s media adviser’s arrest till August 7 | Chandigarh News
The Punjab and Haryana High Court on Wednesday stayed the arrest of former media adviser of former Punjab CM Captain Amarinder Singh’s media adviser, Bharat Inder Singh Chahal, till August 7 during the course of investigations by the Vigilance Bureau in a disproportionate assets case.
The high court, which is hearing the anticipatory bail plea of Chahal, had on June 1 this year ordered him to appear before the officer which is investigating two of his properties. The HC then had made it clear that theinquiry report, if finalized, would not be given effect to.
During the resumed proceedings of the case on Wednesday, Deputy Advocate General for Punjab, Luvinder Sofat, submitted that in view of the fact that a direction had been given that the inquiry, if finalized, be not given effect to, the competent authority is not able to take a final decision with respect to the registration of the FIR. The state counsel stated that the said part of the order dated June 1, be modified in as much as the state be permitted to conclude the inquiry and to give effect to the same.
Sofat told the HC that in case the competent authority comes to the conclusion that an FIR is required to be registered, then till the next date of hearing, the petitioner would not be arrested and a copy of the FIR, if any, would be handed over to KS Nalwa, counsel for the petitioner by August 4.

The petitioner’s counsels agreed to Sofat’s submission and urged the court to ensure that Chahal is not arrested till the next date of hearing, which is August 7.
Hearing the matter, the bench of Justice Vikas Bahl modified its June 1 order, and permitted the state to conclude the inquiry and to give effect to the same and in case, they come to the conclusion that an FIR is required to be registered in the present case, then the state was directed to hand over a copy of the FIR to KS Nalwa, counsel for the petitioner by August 4.
“Till the next date of hearing, the arrest of the petitioner in the present case is stayed”, ordered the HC.
Chahal, through his counsels — Senior Advocate RS Cheema with Advocate KS Nalwa — has previously contended before the HC that he was victimized on number of occasions and he successfully came out of those accusations by exercising his legal rights. Now another inquiry was pending against him and the same was being conducted by the Vigilance Bureau Punjab. The said inquiry is in respect of two properties which is marriage palace on Patiala-Fatehgarh Sahib Road in the area of Bagrian village, Fatehgarh Sahib, and construction on a commercial site located at PUDA Enclave-1, Nabha Road, Patiala.
